Gabriel Aubry is not taking anything Halle Berry and her fiance Olivier Martinez are throwing at him lying down. He has obtained a restraining order against Olivier and now he is in court requesting to have access to his daughter Nahla.
In his declaration in court filed by his lawyer Shawn Holly on Monday, Gabriel painted a completely different picture of what actually went down that fateful day. He said that the day before Thanksgiving he took his daughter to school to play. Halle and Olivier later showed up and then Olivier walked up to him and whispered in his ear in French: ‘I wish I could beat the s**t out of you right now. You’re lucky we’re in a school right now. We’re going to take Nahla right now and you’re not going to follow us.’
Then the next day, as he dropped off Nahla at Halle’s house, Olivier was the one to receive him instead of the nanny as usual. Gabriel claims that Olivier said, ‘We need to talk’ and as he was going to close his car door, Olivier jumped on him and started beating him, screaming as he pounded him that he cost them $3 million in the failed custody battle, as well as that they would still move to Paris and threatening to kill him if he ever comes close again.
TMZ also reports that Gabriel said that Olivier informed him during the beating: ‘We called the cops,’ and that when they show up, “you’re going to tell them that you’re the one who attacked me, or I’m going to kill you.’
Gabriel tendered the pictures of his brutally manhandled face as evidence.
Concerning his daughter Gabriel said that Halle Berry lost her bid for primary custody and they have 50-50 custody. Today he is going to family court to drive home his point, while Halle is busy trying to get a permanent restriction order against him.
Halle Berry’s camp is still insisting that Gabriel is the bad guy.
