Kelly Rutherford burst into tears in court on Wednesday after a federal court judge told her that he can’t help her in her fight to keep her kids in the USA.
As ENTmania! reported, Rutherford is saying that a state judge’s ruling that granted custody to her estranged husband Daniel Giersch – who lives in France and can’t enter the US due to immigration issues – effectively deported her kids, who are US citizens. She took her case to the federal court, where she asked the judge to overturn the decision so that her kids can remain in USA.
But the judge shot down her request, saying that he does not have the power to do so. That was when the desperate Gossip Girl actress broke down in tears, exclaiming, ‘My own country won’t save my children and I pay taxes!’ outside the court.
The judge, however, showed some compassion for the embattled mom, promising her that he will set up a conference call with him, her and Giersch’s lawyer on Friday to discuss how to find a way for Giersch to resolve his immigration issues and return to live in US with them.
If that doesn’t work, her kids will have to move to France on August 19.
