Kelly Rutherford has won sole custody of her two kids … at least temporarily.
A California court on Friday issued a ruling mandating Kelly’s ex husband Daniel Giersch to immediately bring back the children, who currently reside in Monaco, to the United States, even as the 3-year old custody battle continues.
The former Gossip Girl star has been locked in a bitter custody battle with Giersch since their split in 2010 … and a year later a different judge ruled that Giersch should have full custody of their son Hermes, 8, and daughter Helena, 6. There was just one big problem: Giersch couldn’t live in the U.S because his passport was revoked … and so he took the kids first to France, and now Monaco.
Kelly has been fighting that ruling ever since, arguing that the judge essentially deported her kids, who are U.S citizens by birth. Last August, she broke down in tears after a federal judge shot down her petition, saying that he doesn’t have the power to overturn the previous ruling.
Recently, Rutherford started an online petition requesting the White House to come to her aid. That petition gathered more than the 100,000 signatures required to get a response.
Now that she’s gotten what she wants, it is now left for Monaco’s legal system to honor the California court ruling, which you can read in full below.
