A court in Santa Monica, CA on Friday granted Sofia Vergara’s ex-fiance Nick Loeb the permission to file a revised suit against the actress over their fertilized embryos.
According to ET, Loeb was allowed to file a revise complaint alleging that Vergara violated an oral agreement that they will bring their frozen t embryos to term via a surrogate.
Kicking against the suit, Vergara’s lawyer Fred Silberberg maintained that ‘there is no legal issue’ since both Vergara and Loeb signed a contract stating that both of them need to agree before anything would be done with the embryos. ‘[The] plaintiff is using this lawsuit to continue to attack [Vergara] in the press and continue to have his own visibility in the press,’ he told the court.
As ENTmania! reported, Loeb originally filed a lawsuit against the Modern Family actress concerning this issue last year under the name John Doe (the new lawsuit will now bear their names), alleging that she was trying to destroy the embryos. Vergara has since denied that, saying instead that she only intends to keep the eggs frozen forever as she doesn’t want to have any baby with Nick.
