Kelly Rutherford has again failed to regain custody of her kids.
On Thursday, a judge in California ruled that the former Gossip Girl actress has no ability to fight for custody in the state because ex-husband Daniel Giersch, who lives in Monaco, already has a court order from the country granting him full custody. Bottom line: California does not have jurisdiction over her case.
This is no doubt a very painful blow for Rutherford, who has been fighting for three years now to regain custody of her children, 8-year old Hermes and 6-year old Helena. Last month, she won the right to bring them back to the U.S for the summer.
But with this ruling, the kids will have to return to their dad in Monaco at the end of the holidays.
The fight is not over though. It’s just that it can’t happen in California.
