Kelly Rutherford has again lost her bid to keep her kids in the US, as a judge has ordered her to return them to their father in Monaco.
As ENTmania! reported, Rutherford refused to send the kids back to Monaco in August 6, as was agreed in the temporary custody she won two months ago. She claimed that since both the New York and California courts have said they do not have jurisdiction over the case, then no court in the US can force her to hand over the kids. In response, the Gossip Girl actress’ ex-husband Daniel Giersch accused her of essentially kidnapping the children.
But on Tuesday, the Manhattan Supreme Court, Judge Ellen Frances Gesmer disagreed with Kelly’s argument, and ordered that the kids be sent to Monaco immediately. Immediately after the court hearing, Giersch’s mother took the kids to the airport … and now they are on their way to rejoin their father.
A visibly distraught Kelly could only mutter, ‘I have no words’ as she left the court after the ruling (video here).
The fight is far from over … a new hearing has been scheduled in Monaco on September 3.
